OOHAi Advertising and Display System Terms

1. Application of These Terms
These Advertising and Display System Terms apply to the use of OOHAi’s advertising and
display services, including car top digital displays, in car advertising displays, audience
measurement and analytics, advertiser and device owner management platforms, and
mobile and web applications used to configure or control devices.
These Terms supplement the OOHAi Global Terms of Use.
2. Eligibility and Authority
By using the advertising and display system, you confirm that you are acting on behalf of a
business or organisation, have authority to bind that entity, and that all information
provided is accurate and current.
3. Campaign Content and Responsibility
Advertisers are solely responsible for the legality, accuracy, and compliance of advertising
content, including ownership or licensing of all creative materials.
OOHAi does not review or approve advertising content for legal compliance unless expressly
agreed in writing.
OOHAi may reject, suspend, or remove content that is unlawful, offensive, or poses
reputational or legal risk.
3.1 Road Safety and Public Environment Requirements
- Advertising content displayed on vehicle mounted or road adjacent displays must be
suitable for public road environments. - Content must not imitate or resemble traffic signals, road signs, warning lights, or
emergency indicators. - Content must not use flashing patterns, colours, or animations that could distract or confuse
road users. - Content must not include imagery, symbols, or messages that could reasonably be
interpreted as instructions to drivers. - OOHAi may reject, suspend, or remove advertising content that poses a road safety risk or
could mislead road users. - Advertisers remain solely responsible for compliance with applicable road safety, transport,
and advertising regulations.
4. Prohibited Content
Advertising content must not be unlawful, misleading, or deceptive, infringe intellectual
property rights, contain hate speech, discrimination, or harassment, promote illegal
activities, or contain malware or harmful code.
OOHAi may remove prohibited content at its discretion.
5. Campaign Delivery and Measurement
Advertising delivery is subject to technical and environmental factors.
Audience measurement is based on aggregated analytics and represents estimates, not
guarantees.
OOHAi does not guarantee specific impressions, reach, or outcomes unless expressly agreed
in writing.
6. Audience Analytics Disclaimer
Audience analytics are provided for informational purposes only.
Advertisers must not attempt to identify individuals, profile specific persons, or combine
analytics with external data to identify individuals.
OOHAi disclaims liability for misuse of analytics by advertisers.
7. Device Ownership and OperationWhere devices are owned or operated by partners or fleet operators, device owners are
responsible for vehicle compliance and installation.
OOHAi is not responsible for vehicle operation or driver conduct.
Device availability may vary based on vehicle usage.
8. Fees and Payment
Fees are set out in applicable order forms, platform interfaces, or agreements.
Failure to pay fees when due may result in suspension of campaigns, removal of content, or
termination of access.
9. Suspension and Termination
OOHAi may suspend or terminate access where these Terms are breached, required by law
or regulation, or necessary to protect systems, users, or reputation.
10. Limitation of Liability
To the maximum extent permitted by law, OOHAi is not liable for indirect or consequential
losses arising from advertising services.
OOHAi’s total liability is limited in accordance with the Global Terms of Use or applicable
agreement.
11. Governing Law
These Terms are governed by the laws of Western Australia.
